terms of service

general terms

➜ I have the right to turn down any commissions.
➜ When commissioning me, please state you've read & agreed with my T.O.S .
➜ Credit to me (@cutehamsy) or a link going back to one of my socials must be explicitly given any time the art is showcased.
➜ I do not allow my works to be used for AI purposes (training, learning, turning into), NFTs, and crypto currency.

cancellation & refund

➜ Commissions are non-refundable once I've started working on it unless I'm unable to finish your order. If that happens, refunds will differentiate based on the commission's status.

payment & process

➜ Methods of payment: bank transfer (for clients in Vietnam) & PayPal
➜ Prices are in USD.
➜ 100% of the payment must be paid after the commissioner has approved the sketch and any additional fees must be paid before I send the final drawing.
➜ The total price of the commissions may increase based on the complexity of the work.
➜ If there are any changes you would like to make, let me know during the SKETCH stage as any edits afterwards will be charged extra fees.
➜ If I, the artist, make any errors in the character's designs that were shown/specified in the given reference, I will make the edits with no additional charges.
➜ The references have to be clear, full-colored, or full-body if it's for half/full-body commission. I won't accept textural only descriptions, pictures of traditional art, blurry or uncolored/ sketchy references. If traditional references please provide a scanned version with color.
➜ Deadlines/rushed orders can be arranged with additional fees.
➜ Turnaround time for completion is from 1 week to 1 month or more depending on how complex the commission is.

commercial license

➜ All commercial commissions must be specified and discussed beforehand
➜ The prices for commercial purposes are often x2 or x3 the total price, depending on each purpose.
➜ I accept commercial uses such as promotional material, and streaming assets (Vtuber branding, Twitch, Youtube, Website, etc.). Please reach out to me to discuss further.

copyright & art usage

➜ The commissioner will receive both watermarked and unwatermarked file(s).
➜ Neither commissioner nor anyone else is allowed to claim, edit, trace, copy, or remove the watermark from the finished product (even if it's commissioned work) without my consent.
➜ I retain all rights over all my works, including but not limited to posting on my social media, using as samples for sales/self-promotion purposes unless otherwise agreed upon.
➜ I will not claim intellectual property or reuse/resell artworks used for personal or commercial projects unless otherwise agreed upon.
➜ The commissioner may use the artwork for personal use (icon/profile pic, header, wallpaper, poster, mousepad, etc.)
➜ Private commissions come with 50% fee of the total price
➜ The commissioner may not sell/profit from the artwork unless it's a commission for commercial use.
